LLC ("O'Neill Beverages") violated the California Labor Code. The O'Neill Beverages lawsuit, Case No. CIV2200067, is currently pending in the Marin County Superior Court of the State of California. The lawsuit alleges O'Neill Beverages violated the Private Attorneys General Act (“PAGA”), which gives rise to civil penalties as a result of O'Neill Beverages' conduct. PAGA authorizes aggrieved employees to file a lawsuit to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code violations. PAGA allows aggrieved employees to step into the shoes of California state regulators to recover civil penalties, which means ordinary citizens are “deputized” as private attorneys general to enforce the Labor Code.
The complaint alleges O'Neill Beverages violated the California Labor Code by failing to: (1) provide compliant meal and rest periods; (2) pay all minimum, regular and overtime wages; (3) provide accurate itemized wage statements; (4) reimburse for required business expenses; and (5) timely pay earned wages.
