The importance of examining the health plan eligibility of dependents was made very clear in a recent ERISA court case.
In the case of Kolbe & Kolbe Health and Welfare Benefit Plan v. Medical College of Wisconsin, Inc., the Court of Appeals concluded that the self-funded health plan was not entitled to a refund of medical expenses that were paid to a hospital for a newborn. The plan administrator dragged its feet for nearly a year before it determined that the newborn did not meet the legal definition of a dependent.
