Last month we reported NLRB posting requirement regarding workers’ collective bargaining and other rights had been upheld by a District Court, but that any sort of penalty had been eliminated. However, that decision was appealed to the District of Columbia Circuit Court of Appeals, which rejected NLRB’s argument that its notice requirement should take effect. The Court stated that it would not hear oral arguments on the merits until September, which means really an indefinite delay. Moreover, another district court has invalidated even the posting requirements. The NLRB has now specifically postponed the implementation of the posting rule indefinitely.
