A provision of the Health Care Reform Act applies to all employers covered by the Federal Labor Standards Act and requires employers to provide “reasonable” break time in a private place other than a bathroom for an employee to express breast milk for her nursing child for one year after the child’s birth. This provision took effect on March 23, 2010, and it is an obligation in addition to what is required by state laws, such as Minnesota. Wisconsin, however, did not have such a law, and therefore Wisconsin employers have this new requirement.
