A recent Minnesota District Court sent to trial a case involving Meslu Tewle, a native of Eritrea, who complained to her HR department about being passed over for a promotion, suggesting that it might have been because of her national origin. The very next day, her boss issued a formal warning about her productivity, and this was the first time she had ever been written up. When more discipline followed, she sued. The Court suggested the timing of the discipline was enough for the Court to send her claim for discrimination and retaliation to trial. Tewle v. Owens & Minor (D.C. Minn. 2009).
