    termination

I have an employee that just doesnt seem she wants to come to work. When she is here she doesnt perform well. She is over her 90 days, employeed 7 months. in that 7 months she has missed 16 fulls days, numerous partial days and many other issues.
Myself and the GM has brought her in and talked about our concerns. She has been seen playing games, social media and online books. She was told that was to no longer happen. 2 days later she was observed doing this all again, when i questioned her if there was something about our meeting she did not understand she informed me she was bored.
she is now telling me she has to miss a "no-excuse" day (our month end day is a day no one is allowed to miss) due to her husband needing to go to the docotr. For the last 3 months she has tried to take all or half a day of month end off. i would like to terminate but want to be well within legal rights.
any advisory i would greatly appreciate!!!
