    Does anyone know if you can require the employee to keep a copy of their prescription drug medication in their personnel file?

    I'm in MA - have never seen it done before and seeking some guidance here

    It would depend on why you need this information. What possible reason would you have to know every antibiotic/vitamin/birth control/pain killers/sleep assistive/skin rash/hormone therapy meds your employees are taking?

    I would not do it. You would be violating various HIPAA or ADA laws. Why would you need to know that information anyway? If it is affecting their work performance then you can send them or drive them home and ask them to take a drug test. Asking someone what drugs they are taking can cause a lot of problems.

    What if you end up firing this person after finding out they are taking drugs for AIDS or epilepsy. Even if they are a bad employee you open yourself up to potential lawsuits for discrimination.
