Post accident drug testing

If a CA employer has a drug free workplace policy, which is followed and has a practice of testing all employees injured in a work related accident, is this a privacy violation?
The written drug policy does not state all employees will be sent for post accident testing, however, it has been a commonplace occurence for at least 10 years. The company is not legally required to test employees in this situation (i.e. DOT required).

The post accident and reasonable suspicion should be added to your employee handbook. Continue to be consistent as you have set a norm. The information should be in the handbook.
