    Need help with a Maternity Leave Program

    My company does not have to follow FMLA at this point.  We do not have a maternity leave program and I am trying to create a reasonable one for the employees and the company.  Right now I am being told that the company will offer two weeks unpaid leave and the employee can elect to take their vacation time with that.  I need to know legally how this can hurt the company if they do not offer more.  We do not have a formal leave policy either.  So I cannot show that we are treating a female employee differently.  I also cannot get our insurance company to say statistically that they see doctor's give anywhere from 4 to 8 weeks off after a delivery for recovery.  If an employee receives a doctor's note saying they cannot return to work for 4 to 8 weeks, legally do we have to give them that time off?  I know we run into ADA and the PDA but can anyone help with documents or case studies?
