    Good afternoon, I have a question for you. We have an individual that has been paid as an employee for one job and independent contractor for other duties. Here is the story on him.

    We are a Park District and this scenario is quite common in the industry.  We pay him as an employee when he is our Softball Supervisor. In this role he oversees our softball complex and handles any issues that may arise while the complex is open and in use.

    We pay him as an independent contractor when he runs a basketball camp. He acts like any other company/person who we contract with to run an activity/program.

    He is also an umpire, but we don't pay him directly for this, we pay the organization that he works for when he umps.

    He is also an assigner for our basketball league that we co-run with a neighboring park district. In this capacity, he coordinates all bb referees and assigns them to games. We do not pay him directly for these services. The other park district does. We pay for all the jerseys, etc and settle up with the other park district at the end of the program.

    Can this individual be both an employee and an IC. If it were separate people, I wouldn't have any question as it makes sense that he be an employee when the softball supervisor and it also makes sense that he would be an IC when running the camp and being an assigner. I just wanted to pass it by you to see if we can have him as both.
