    I am looking for more information relating to the determination of whether a person is considered an employee vs. an independent contractor, when the contractor is supplied by a third party (staffing agency) and is paid by that third party.

    I have all the general data regarding the differences, but I am wondering if the third party agency makes any difference. 

    For example, if you are using the staffing agency to provide you with an IT position (Data Base Administrator) for a 1 year period, and that contractor uses your equipment, must be introduced to your database environment, and works the same hours as all your permanent employes performing the same job, but is paid by the staffing agency, are they still always considered contractors?  Would there still be a legal issue relating to qualifying for benefits that employees receive?
