Culbertson, recently represented a client (plaintiff) in a case (Case No. 6:15-cv-990-Orl-37GJK filed in the United States District Court Middle District of Florida Orlando Division) who was awarded Social Security disability benefits after fifteen years, four administrative hearings and four Federal Court appeals. The judge in the case awarded the plaintiff the disability benefits she is due, which had previously been denied, for the period from February 28, 2001, through August 3, 2011.
Court documents state that during the course of the fifteen-year legal battle, the plaintiff lost her home, the State took her children and she had not been able to get the appropriate medical treatment she needed for her serious documented physical and mental impairments. As a result, according to court documents, her conditions have worsened, and she has been homeless most of the last fifteen years, during which time she was physically attacked while living in the woods. According to court documents, the judge in the case found “it is clear that the handling of this claim at the administrative level has been a travesty by any objective measure and has worked to inflict a grave injustice upon the plaintiff.”
“We see hundreds of disabled people who have to file multiple complaints in Federal Court before they get a fair hearing before a fair Social Security Administrative Judge,” said Culbertson, attorney for the plaintiff. “Our client will now receive retroactive benefits, but this money will not undo the hardship she has suffered over the last fifteen years.”
