EB-3 CHINA RETROGRESSION UPDATE
The May 2014 Visa Bulletin showed that immigrant visas were available for EB-3 China cases with priority dates of October 1, 2012 or earlier. Unfortunately, the
June Visa Bulletin shows that EB-3 China cases have retrogressed by six years to October 1, 2006. This retrogression means that as of June 1, U.S. Citizenship & Immigration Services (CIS) will not accept applications to adjust status to permanent residence (Form I-485 if applicant is in the U.S.) for those individuals born in China with EB-3 priority dates on or after October 1, 2006. This retrogression also means that pending applications that were filed before June with priority dates on or after October 1, 2006 cannot be approved, and will be placed in pending status until visa numbers are again available for the individual’s priority date.
