    Allowing Employees to Work Off-The-Clock Could Mean A Fine For Their Supervisors, Not Just Their Employers


     Having trouble persuading supervisors to stop allowing their employees to work off-the-clock overtime? Here’s a little something that could convince them to stop this practice – they could get themselves sued!

    The Fair Labor Standards Act (FLSA) actually allows employees to sue supervisors who break the law as well as the company that employs the worker.

    As a result, supervisors, managers and HR professionals’ personal assets are under threat when an employee works undocumented overtime.

    Failure to pay overtime could mean a lawsuit that looks back over three years and that could easily escalate into a class-action lawsuit involving many employees, causing spiraling costs and legal fees.
