The Fair Labor Standards Act (FLSA) actually allows employees to sue supervisors who break the law as well as the company that employs the worker.
As a result, supervisors, managers and HR professionals’ personal assets are under threat when an employee works undocumented overtime.
Failure to pay overtime could mean a lawsuit that looks back over three years and that could easily escalate into a class-action lawsuit involving many employees, causing spiraling costs and legal fees.
