    EMPLOYERS' OBLIGATION IS TO MAINTAIN HEALTH BENEFITS UNDER FMLA


    The health benefit obligation exists if the employee has not informed the employer of no intent to return to work, but the employee is required to pay their regular portion of the premium. Moreover, this obligation to pay or continue premium payments terminates when any required employee contribution is more than 30 days late, so long as the employers give the employees written notice at least 15 days in advance advising them that coverage will cease. Therefore, notice should be given if not paid within 10 days of the due date. The due date is normally the date deduction would be made from the employee's paycheck. No other benefits need to be maintained, and no additional charge can be made for administration.
