    Legal Responsibility of Employer when an employee is injured from a fall.


    Scenario:  An employee of a home health organization falls while attending to a patient and fractures her elbow.  Although nothing was put in writing from the employer or the doctors, our company paid for doctors visits and physical therapy visits for the employee since December, 2010.  The employee has now complained to her doctor that she is still in pain and has scheduled surgery for Monday, 3/28.  The doctors office is now calling our office for prepayment of the surgery. 

    Question: From a legal standpoint, is our firm responsible for paying her surgery bills?
