    EEOC REPORTS INCREASE IN DISCRIMINATION FILINGS FOR FISCAL YEAR 2010


    The number of filed charges in the last fiscal year (2010 compared to 2009) has increased 7%. However, for the ten year period, charges are up nearly 24%. They have risen substantially in the last three years, which coincides with the beginning of the recession. This is likely an indication that many charges have been filed by discharged or laid-off employees. It is interesting to note, however, that there has not been any substantial increase in the number of charges under the Equal Pay Act, which has gained a greater notoriety in light of the change in the statute of limitations issue. Obviously, documentation of the reason for terminations and layoffs is most important.
