Discrimination against caregivers in the workplace is a growing problem. According to WorkLifeLaw.org, from 2000 to 2010, there has been a 400 percent increase in the number of lawsuits filed against employers by employees with family caregiver obligations.
EEOC Regulations
1.The U.S. Equal Employment Opportunity Commission (EEOC) does not specifically forbid discrimination against caregivers. However, the employer may not demonstrate a bias based on sex, race, marital status, parenthood, disability of family members or pregnancy of the caregiver, for example.
Prevalence
2.Discrimination against caregivers at work occurs throughout the U.S. and in all sizes, types and every level of business. Litigation against employers for discrimination is successful in nearly half of cases and verdicts average over $500,000 in damages, explains WorkLifeLaw.org.
Employers
3.Many employers do not understand their legal responsibilities towards employers who are caregivers and may not know that caregivers have legal recourse. Most caregiver responsibilities involve multiple children or older adults.
